SnapDat™ Networks, Inc. (herein referred to as SnapDat™ or the Company) understands that you care about how your personal information is used and shared, and we take your privacy seriously. Please read the following to learn more about our privacy policy (this “Privacy Policy”). This Privacy Policy is subject to the Terms of Use provided on the www.snapdat.com website and under which the Software and Services defined therein are used. All definitions in the Terms of Use control in this Privacy Policy.

A Note About the Privacy of Children Under 13

The Site, Services and Software are not directed or otherwise promoted for use by children under the age of thirteen (13). We do not knowingly collect or use personal information of anyone under the age of thirteen (13).

WHAT IS OUR PRIVACY POLICY?

Your privacy is important, so SnapDat, Inc., (“SnapDat” or the “Company”) has created the following Privacy Policy to let you know what information we collect when you visit the Site or use the Software or Services, why we collect it and how it is used. This Privacy Policy explains the data collection and use practices of the Company in connection with the services available to you pursuant to SnapDat™ membership, including access to the Site and use of the Software or Services; it does not apply to other online or offline Company sites, products or services or to the practices of third parties that we do not own or control, or to individuals that we do not employ or manage. The terms “you,” “your,” and “yours” refer to the customer/purchaser utilizing our Site. The terms “Company,” “SnapDat,” “we,” “us,” and “our” refer to SnapDat, Inc. This Privacy Policy is governed by our Terms of Use. By using the Software, Services or Site, you consent to the data practices prescribed in this statement. We may periodically make changes to this Privacy Policy that we will include on this page at any time without notice. It is your responsibility to review this Privacy Policy frequently and remain informed about any changes to it, so we encourage you to visit this page often.

WHAT INFORMATION IS COLLECTED?

“Personally Identifiable Information” means any information that may be used to identify an individual, including, but not limited to, a user ID, a first and last name, home or other physical address, an email address, phone number or other contact information, whether at work or at home, that is entered at registration or otherwise into a user’s profile. Our primary goal in collecting Personally Identifiable Information is to provide you with a friendly, customized, and efficient experience and to enable the exchange of your information, including such Personally Identifiable Information, with other users through the Software and Services or to otherwise use the Software and Services. We only collect Personally Identifiable Information that is relevant to the purpose of the Site, Software and Services. We do not process this information in a way that is incompatible with the purpose for which it has been collected or subsequently authorized by you. The Company collects the following Personally Identifiable Information from you when you use the Site, Software and Services: Information You Provide to Us:

We receive and store any information you enter through the Software, Services and/or Site or provide to us in any other way. The Personally Identifiable Information you provide is used for such purposes as registration, for exchanging Personally Identifiable Information with other users or otherwise using the Software and/or Services, and as indicated herein.

When you register on to use the Software and Services, you will be asked for basic registration information, such as a user ID and password which you choose, first name, last name, telephone numbers, mail addresses, and an e-mail address(es). Additional information may be required to utilize the Software and Services. We will use this information for providing the Software and Services.

We will store all Personally Identifiable Information, electronic business cards generated and received by users, all information in such cards, and transactional data such as identification of who sent a card, who received a card, etc., at a SnapDat™ server or servers. At your request, direction or other indication, we will share such information with other users per the Software and Services.

Automatic Information: We may receive and store certain types of information whenever you interact with us, the Site, Software or Services. We may receive and record certain "traffic data" on our server logs from your browser, including your IP address, SnapDat™ cookie information, the transactions you conduct on our Site, your communications with SnapDat™ and our Site and the page you requested. We use this traffic data to help diagnose problems with our servers, analyze trends and administer the Site.

SnapDat™ and its affiliates may use your Personally Identifiable Information to provide you with SnapDat™ product information, to provide and support the Software and Services, to notify you of technical updates or changes to this Privacy Policy or other policies (by posting the updates or changes to the Site), for license reporting and assessment of service levels, to better understand on an aggregated basis how the Software or Services are used, gauge traffic patterns and determine what types of content and services are most popular with users of our products and services, to verify access rights to content, services or software, to provide you with information about products, services, news and events through the Software, Services, the Site or e-mail, to allow you to purchase and download SnapDat™ products and services, to provide you with personalized content programming, instructions and services, and/or to deliver other customer services.

Your Personally Identifiable Information is your own and you decide who will have access to it. You maintain ownership rights to your Personally Identifiable Information, even if there is a business transition or policy change. You may add, delete, or modify your Personally Identifiable Information at any time. SnapDat™ will not update or modify your Personally Identifiable Information without your permission.

IS THE PERSONALLY IDENTIFIABLE INFORMATION SHARED OR DISCLOSED?

SnapDat™ does not rent or sell Personally Identifiable Information to third parties. SnapDat™ does not send spam, maintain spam mailing lists, or support the activities of spammers. Personally Identifiable Information is used to complete and support your use of the Site, Software, and Services and to comply with any requirements of law. SnapDat™ may share Personally Identifiable Information with third parties only as described below:

Required by Law; Protection of SnapDat™ and Others: SnapDat™ may disclose Personally Identifiable Information if required to do so by law or in the good faith belief that such action is necessary to: (1) conform to the edicts of the law or comply with legal process served on SnapDat™ or its affiliates or the Site; (2) protect and defend the rights, property or safety of SnapDat, our employees and contractors, our users or others; (3) act in urgent circumstances to protect the personal safety of users of the Site, Software and/or Services, its web sites or the public; (4) enforce or apply our Terms of Use and other agreements. The foregoing includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

Providing our Services: The Software and Services necessarily require that your Personally Identifiable Information be shared with other third-parties, as requested, directed or otherwise indicated by you. You consent to such sharing. Otherwise, we depend upon third party service providers to license data to us and to provide other services to SnapDat™ necessary for the provision of the Services. For example, in order to provide you with our Services, we may disclose your Personally Identifiable Information to third party service providers that facilitate the Service’s interactions with such credit card companies or banks, in order to obtain the information that you requested be aggregated and displayed through our Site. When you register for our Software and Services, you are deemed to authorize disclosures by us to provide the Software and Services.

Bankruptcy; Change of Control: If SnapDat™ should ever file for bankruptcy or be acquired by another company, whether by merger, stock transfer, or sale of assets, we may sell or otherwise transfer control of the information you provide to us on the Site or through the Software or Services, including the Personally Identifiable Information, to a third party or share your Personally Identifiable Information with any company with whom we merge or to whom we sell ourselves or our assets.

User Consent; Opt-Out Rights: Except as set forth above, so long as you have provided your email address to us, you will be notified when your Personally Identifiable Information may be shared with third parties (except as requested, directed or otherwise indicated by you during your use of the Software or Services) or used for a purpose incompatible with the purpose(s) for which it was originally collected, and you will be able to prevent the sharing of this information by opting out. Tell A Friend: Any function provided by SnapDat™ whereby you may recommend the Site, Software or Services to a friend may identify you by username or email address when you send email through the Site. We reserve the right to share aggregated information with third parties in which case Personally Identifiable Information about you will never be disclosed.

IS THE INFORMATION SECURE?

The security of Personally Identifiable Information is a priority for us. We protect this information by maintaining physical safeguards, such as secure areas in buildings; electronic safeguards, such as passwords and encryption; and procedural safeguards, such as customer authentication procedures, all in accordance with applicable law. We train our employees in the proper handling of personal information; we also limit employee access to this information to those employees with a business need for access and we enforce employee responsibilities through appropriate disciplinary processes. The SnapDat™ database is physically protected at a secure, third party site and is monitored by security personnel twenty-four hours a day. Only authorized personnel can access the data center.

Your SnapDat™ account information is protected by your account password for your privacy and security. You need to work to protect against unauthorized access to your password and mobile device.. You are responsible for the security of Personally Identifiable Information at the client level, including on any mobile device with which you use the Software and Services.

LINKS TO OTHER SITES

You should be aware that this Privacy Policy applies only to the Company’s Site. Importantly, it does not apply to any other websites to which a link may be provided as part of the Site. We cannot control and are not responsible for the actions of third parties operating such sites. You should not take the existence of an affiliation with, or a link from, the Site to any such other website to mean that it has a privacy policy similar to this one. You should review the privacy policy of any such website.

INTERNATIONAL TRANSFERS

Personally Identifiable Information collected on this web site may be stored and processed in the United States or any other country in which SnapDat™ or its affiliates, subsidiaries or agents, including third party service providers who provide services to SnapDat™ in connection with the Service, maintain facilities and/or infrastructure, and by using the Site, Services and Software, you consent to any such transfer of information outside of your country.

DOES YOUR SITE USE COOKIES?

Cookies are small text files stored by your browser in your computer when you visit our Site. We use cookies to improve our Site and make it easier to use. Cookies permit us to recognize users and avoid repetitive requests for the same information. Most browsers will accept cookies until you change your browser settings to refuse them. We use cookies for a variety of purposes intended to make our Site a better service for you. For example, we use a cookie to identify existing users of our Services when they enter our Site so that we are able show the third party account data registered with us by existing users and so that they may receive a start page more optimized for current subscribers than for new users. We also use a cookie to maintain session information for logged in users, to prevent the need for re-entry of login information when browsing outside our Site. We reserve the right to use cookies to deliver content specific to your needs and interests. We may also use cookies to track user trends and patterns in order to better understand and improve areas of our sites that our users find valuable. We reserve the right to use outside ad companies to display ads on our sites. These ads may contain cookies. Cookies received with banner ads are collected by our ad companies, and we do not have access to this information.

YOUR CONSENT TO THIS PRIVACY POLICY

By using the Software, Services or Site, you agree to this Privacy Policy. This is our entire and exclusive Privacy Policy and it supersedes any earlier version. Our Terms of Use take precedence over any conflicting Privacy Policy provision. We may change this Privacy Policy by posting a new version of this Privacy Policy on the Site which it is your responsibility to review. We encourage you to periodically review this Privacy Policy to stay informed about how we are protecting the Personally Identifiable Information we collect. Your continued use of this Software, Services or Site constitutes your agreement to this Privacy Statement and any updates.

LEGAL DISCLAIMER

The Software, Services and Site operates “AS-IS” and “AS-AVAILABLE,” without liability of any kind. We are not responsible for events beyond our direct control. You are responsible for the security of Personally Identifiable Information at the client level, including on any mobile device with which you use the Software and Services. This Privacy Policy is governed by the laws of New York, excluding conflicts of law principles. Any legal actions against us must be commenced in New York within one (1) year after the claim arose, or such action(s) will be barred.

CALIFORNIA PRIVACY RIGHTS

California Civil Code Section 1798.83 permits users that are California residents to request that we not share your Personally Identifiable Information with third parties for their direct marketing use if we know or have reason to know that the third parties use the Personally Identifiable Information for the third parties’ direct marketing purposes. For your protection, we exercise this right on your behalf and require the third parties we hire to perform services for us to keep all Personally Identifiable Information secure and to not permit any use of Personally Identifiable Information for their direct marketing use or for any purposes other than those for which the company was hired.

MISCELLANEOUS

SnapDat™ reserves the right to change the Privacy Policy and will post a notice on the Site when making such a change. SnapDat™ may also notify users via the Service at provided e-mail addresses when making such changes. In the event of a transfer of ownership of SnapDat, such as acquisition by or merger with another company, we will provide notice before any personally identifying information is transferred and becomes subject to a different privacy policy.
